In the past, a work would enter the public domain in the United States if it was released without a copyright notice. This was true prior to March 1, 1989, but is no longer the case. Any work (of certain, enumerated types) now receives copyright as soon as it is fixed in a tangible medium.
In general, if the image cannot be reused (including with redistribution and modification rights) by any entity, including commercial users, then the image must be considered non-free. Use of copyrighted material under an invalid claim of a non-free rationale constitutes copyright infringement and is illegal.
